ANABI took custody of four seized movable assets worth 800.000 Euros

During the current week, the National Agency for the Management of Seized Assets (ANABI), following the order issued by the prosecutors from Directorate for Investigating Organised Crime and Terrorism (DIICOT) - Central Structure, has taken under management 4 luxury cars (1 Ferrari Portofino, 2 Lamborghini Urus and 1 BMW X4). The total value of the assets taken under ANABI’s management, in this case, is estimated at approximately LEI 3.93 million (€800,000).

The Agency has been notified on the basis of Article 28 of the Law no. 318/2015. According to the above-mentioned powers, ANABI manages movable assets with an individual value higher than EUR 15,000. Also, during all phases of the criminal proceedings, with the consent or at the owners’ request or with the court's authorisation, ANABI is entitled to sell the seized movable assets through online public auctions.

The seizure was ordered in a case with a cross-border dimension, in which investigations are carried out regarding offences of setting up an organised crime group, robbery, theft, fraud with extremely serious consequences and money laundering. We reiterate that the Agency’s activity is governed by the principles of legality, confidentiality, integrity, operational autonomy, celerity, efficiency and respect of the rights and legitimate interests of owners, holders of other rights and third parties.

ANABI is a public institution endowed with legal personality, under the subordination of the Ministry of Justice. By the Law no. 318/2015, the Agency is designated as:

-             the national asset recovery office, in the sense of the Council Decision 2007/845/JHA of 6 December 2007 concerning cooperation between Asset Recovery Offices of the Member States in the field of tracing and identification of proceeds from, or other property related to, crime;

-             the national asset management office, in the sense of art. 10 of the Directive 2014/42/EU of the European Parliament and of the Council of 3 April 2014 on the freezing and confiscation of instrumentalities and proceeds of crime in the European Union.

Currently, the total value of the assets under ANABI's management is worth approximately €9.72 million, of which €4.43 million is the value of the assets taken under management in 2023. These include several types of virtual currency (BNB, BTC, BUSD, DOGE, ETH, ETHW, GBP, JEX, LINK, SOLO, USDT, XRP, WBTC, HARD).

The balance of the money actually seized in criminal proceedings, deposited in ANABI’s sole account, is currently of LEI 328,604,403.74, of which LEI 1,752,399.37 represents the value of the assets sold by the Agency during the current year.
